The District Court judge denied the plaintiff's request for class certification primarily on the basis that the alleged failure to disclose the appraisal inflation scheme, even if true, was not material to First American overall -- as the judge noted, the appraisal venture with Washington Mutual amounted only to .3 percent of First American's total revenues.

New York Attorney General lawsuit against eAppraiseIt regarding alleged appraisal manipulation for loans originated by Washington Mutual.  When Attorney General Cuomo threatened to bring related claims against them, FannieMae and FreddieMac entered into a pre-litigation agreement, resulting in the Home Valuation Code of Conduct.
